Welcome to Garac Business Group LLC (“Company”, “we”, “our”, or “us”).
These Terms of Service (“Terms”) govern your access to and use of our website https://strahinjaergarac.com (the “Website”), as well as any related services, products, materials, or digital assets we provide (collectively, the “Services”).

By using our Website or engaging our Services, you agree to be bound by these Terms in full.
If you do not agree, please discontinue use of our Website and Services immediately.

Our company operates in accordance with the laws of the State of Wyoming, United States.

2. Scope of Services

Garac Business Group LLC provides professional fashion videography, creative direction, and visual production services for brands, agencies, and private clients.

Our Services may include (but are not limited to):

  • Concept development, scripting, and storyboarding
  • Location scouting and production planning
  • Filming, directing, and coordination on set
  • Editing, sound design, grading, and post-production
  • Delivery of finalized visual assets in agreed formats

We may also provide optional add-ons such as behind-the-scenes coverage, short-form edits (Reels, TikToks), photography, or brand consultancy.
All Services are provided on a project-by-project basis and confirmed only upon written agreement, signed proposal, or accepted invoice.

3. Booking and Project Confirmation

To reserve a project date:

  • A non-refundable deposit (percentage defined in the proposal) is required to secure the booking.
  • Dates are confirmed only once payment is received.
  • Verbal or tentative agreements do not guarantee availability.

We strongly recommend early booking, especially during peak seasons.

Any changes to project details (location, schedule, scope, deliverables) must be communicated in writing and approved by both parties. Significant changes may result in adjusted fees or rescheduling.

4. Payment Terms

Unless otherwise stated in your proposal or contract:

  • A non-refundable deposit confirms the booking.
  • The remaining balance is due before delivery of the final materials.
  • Payments are accepted via bank transfer, card payment, or other agreed methods.
  • In case of late payment, we may:
    • Pause all ongoing work
    • Withhold delivery of final materials
    • Apply late fees of up to 5% per week overdue

Invoices not settled within 30 days may be subject to debt collection through a third-party agency.

5. Cancellation and Rescheduling

Client-initiated cancellations:

  • Cancellations made within 7 days of the shoot will result in forfeiture of the deposit.
  • Cancellations made within 48 hours of the shoot may incur additional fees for crew, equipment, or location rentals.

Rescheduling:

  • Rescheduling requests must be made at least 7 days in advance and are subject to availability.
  • If unavailable, the project may be postponed to the next available date.

Force majeure (e.g. illness, natural disasters, travel restrictions, government actions):

  • Both parties agree to make reasonable efforts to reschedule the project without penalty.
  • In extreme cases, refunds (minus actual costs) may be issued at our discretion.

6. Creative Direction and Artistic Discretion

By engaging our Services, you acknowledge that you have hired Garac Business Group LLC for its unique artistic style and creative judgment.

While we welcome your input, final decisions regarding editing, color grading, soundtrack, pacing, and artistic presentation are made at our discretion unless explicitly outlined in a written contract.

We reserve the right to refuse any request that:

  • Compromises artistic or ethical standards
  • Endangers team safety
  • Violates copyright or industry norms

7. Delivery and Revisions

Final deliverables will be provided via:

  • Private download link, shared drive, or cloud platform
  • USB/hard drive (if agreed in writing)

Delivery timeframe: Typically 14–45 business days after production, depending on complexity.
You will be informed of the estimated delivery date prior to project start.

Revisions:

  • One (1) round of minor revisions (color, transitions, timing) is included.
  • Additional revisions, re-edits, or re-shoots requested after delivery are billed at an hourly rate or as quoted.
  • Major changes outside the original scope may require a new contract or supplemental invoice.

8. Intellectual Property and Usage Rights

  • All raw footage, project files, and unedited materials remain the property of Garac Business Group LLC.
  • Upon full payment, the client receives a non-exclusive, royalty-free license to use the final edited materials for the intended commercial or promotional purpose stated in the contract.
  • Clients may not resell, sublicense, or modify the materials without written consent.

We retain the right to use completed works for our portfolio, social media, website, and marketing, unless otherwise agreed in writing before production.

If exclusivity or full ownership transfer is requested, additional fees may apply.

9. Model Releases and Location Permissions

Clients are responsible for:

  • Obtaining all necessary model releases for individuals appearing in the video.
  • Securing location permissions and paying related fees, unless agreed otherwise.

Garac Business Group LLC is not responsible for any claims, disputes, or penalties arising from the lack of such permissions.

10. Client Responsibilities

You agree to:

  • Provide accurate project information, access, and schedule availability.
  • Ensure all required parties (models, stylists, makeup artists, etc.) are present and ready at agreed times.
  • Communicate creative preferences before filming begins.

Delays caused by the client or third-party collaborators may result in extra fees or adjusted deadlines.

11. Limitation of Liability

To the maximum extent permitted by law:

  • Garac Business Group LLC shall not be liable for indirect, incidental, or consequential damages, loss of profits, or data.
  • Our total liability is limited to the total amount paid by the client for the specific project.
  • We make no guarantees regarding uninterrupted access to our Website or Services.

In case of data loss or technical failure, our liability is limited to refunding the affected portion of Services, if applicable.

12. Confidentiality

All client information, footage, and communications are treated as strictly confidential.
We may share materials only with team members or subcontractors directly involved in production, and they are bound by confidentiality agreements.

We will not disclose your information to third parties except as required by law.

13. Data Protection and Privacy

We comply with GDPR and relevant U.S. data protection laws.

By using our Services, you consent to this processing.

14. Equipment and On-Set Safety

Our crew uses professional, insured equipment.
Clients agree to provide a safe working environment for all personnel and equipment.
If unsafe conditions arise (weather, crowding, hazards), we reserve the right to pause or terminate the shoot without refund.

Any damage to our equipment caused by the client or their associates will be billed to the client.

15. Independent Contractors

Garac Business Group LLC may collaborate with freelancers, stylists, models, and other subcontractors.
Such parties are independent contractors, and we are not liable for their personal actions beyond contracted work.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict of law principles.
Any disputes shall be resolved exclusively in the courts of Sheridan County, Wyoming.

We may update these Terms periodically.
The latest version will always be available on this page, with the “Last updated” date reflecting the most recent revision.

Your continued use of the Website or Services after changes indicates acceptance of the updated Terms.
